Balotelli is allowed to almost break people's legs

Mario Balotelli will not be banned for almost removing Alex Song's leg in a challenge during the game between Arsenal and Man City.  More specifically, this challenge:

The referee's view was obstructed so he wasn't able to produce the red card that this deserved and now the FA have said:
"Retrospective action can only be taken in scenarios where none of the match officials saw the players coming together.
The normal scenarios in which retrospective action is taken are for 'off-the-ball' incidents."
And therefore Balotelli will escaped unpunished.  This all sounds very fair to me and is an example of why I always use the cloak of darkness that is night when I go out and launch flying tackles at innocent civilians in the street.  Why should television and a stadium of 60,000 people make a difference here?  I guess the only real difference is that actual judges give you in trouble - they just don't understand my art!
